The Selden Patent- In 1879, George Selden, an inventor and patent attorney filed a patent application disclosing a machine we now call an automobile. Selden, recognizing that the emergence of the automobile industry was years away, managed to delay issuance of the patent until 1895. He insured that claims of the issued patent were broad enough to cover an Otto cycle engine, the gasoline powered engine of choice at the time. From the time the patent was issued in 1895 until it expired in 1912, any manufacturer of a gasoline powered motor vehicle made or sold in the U.S. (there were about 1,000 at the time) had to make an agonizing choice. Do we take a costly license under the Selden’s patent or flaunt the patent and risk even more costly lawsuit? How the manufacturers dealt with choices – from minor players to major players like Ford – provides an intriguing view into the pioneer times of the motor vehicle industry.
